APPLICABLE REGULATIONS
The personal data you transmit to us will be processed in accordance with the provisions of Swiss federal legislation on data protection. Since 2000, Swiss legislation has been recognized by the European authorities as granting personal data protection equivalent to the European regulations on the subject.

1) Browsing the website
Each time you access our website, our system automatically collects data and information from the operating system of the computer you are using.
The following data is collected:

  •     Information on browser type and version
  •     User’s operating system
  •     User’s Internet service provider
  •     User’s IP address
  •     Date and time of access
  •     Websites from which the user’s system accesses our site
  •     Websites accessed by the user’s operating system via our site

Log files contain IP addresses and any other data that can be attributed to a user. This could be the case, for example, if the link to the website from which the user accesses the website or the link to the website to which the user switches contains personal data. The data is also stored in our system log files. It is not stored with other personal user data. The temporary storage of the IP address by the system is necessary to enable the use of our content on the user’s computer. The user’s IP address must therefore be stored for the duration of the session. Storage in log files ensures website functionality. In addition, the data is used to optimize the website and ensure the security of our information technology systems. No data is analyzed for marketing purposes in this context. Our legitimate interest in data processing also lies in these purposes.
Data is stored for 5 years.

2) Contact page
Our website features a contact form for electronic contact. If the user chooses this option, the data provided in the input mask is transmitted to us and stored. This data includes :

  •     Last name
  •     First name
  •     Phone
  •     Email address
  •     Service(s) concerned
  •     Message

When the message is sent, the following data is also stored:

  •     User IP address
  •     Date and time of registration

By sending the form you consent to the processing of your data, otherwise we will not be able to reply. You can also contact us via the e-mail address provided. In this case, the user’s personal data is transmitted with the email and stored. No data is disclosed to third parties. They are used exclusively for the purposes of the conversation.
Personal data is used for the purposes stated at the time of collection, in connection with the conclusion or execution of contracts (performance of services, ordering of products), for purposes dictated by circumstances or legislation and/or for marketing and analysis purposes. When personal data is collected, the data marked with a red asterisk indicates that which is absolutely necessary for the performance of the service subscribed to or the product ordered. Without this data, we will not be able to fully satisfy your request. The data transmitted to Proactif may be transferred to and used by Groupe Proactif (Holding) SA subsidiaries and affiliates in order to carry out the services subscribed to and also for marketing purposes and analysis of grouped products.
Data may also be transferred to third parties for the performance of contractual services (third-party partners) or for processing on behalf of Proactif. In this case, Proactif ensures that the third party complies with legal provisions. Furthermore, your personal data will not be sold or passed on to third parties without your consent.

3) Subscription to the Proactif newsletter
If you have subscribed to the newsletter, we use the data you provided at the time of registration to send you the Proactif newsletter and other information or commercial offers. If you no longer wish to receive newsletters, you can unsubscribe by clicking on the unsubscribe link contained in each of our newsletters.

4) LinkedIn
If you have signed up to receive magazines in digital format, we use the data you provided when registering to send you our newsletter and other information or commercial offers. If you no longer wish to receive communications from us, you can exercise your rights with regard to your data at any time:

5) Data collected by social networks 
Proactif offers you the use of social networks to improve the commercial relationship and to propose targeted advertising offers on these networks.
 
The use of social networks to interact with Proactif (including in particular the META, Twitter/X or Linkedin platforms and tools) is likely to result in data exchanges between Proactif and these social networks. 
 
For example, if you are connected to the Facebook social network on your computer and you consult a page on the Proactif site, Facebook is likely to collect this information. Similarly, if you click on the “tweet” button on a page of the Proactif site, Twitter will collect this information.
 
Proactif invites you to consult the personal data management policies of the various social networks for information on the personal data that may be transmitted by them.

DATA SECURITY
Please note that the Internet is a global network accessible to everyone. Sending or transferring personal data over the Internet using your computer is at your own risk. If you place an order on a page of the site that allows online payment, the personal data you transmit to us is protected by Secure Socket Layer (=SSL). Despite the implementation of technical measures by Proactif, it is always possible that data may be lost, intercepted or manipulated by unauthorized third parties. Furthermore, your computer is outside the security perimeter controlled by Proactif. As a user, you are responsible for taking appropriate security measures.

RIGHT OF ACCESS
Any data subject who has undergone the processing of personal data has the right to obtain information on the personal data stored concerning him or her at any time, free of charge, as well as the right to access a copy of such data by the data controller. You may request confirmation from the data controller as to whether it is processing your personal data.

RIGHT OF RECTIFICATION
Any data subject whose personal data has been processed has the right to request the immediate correction of any erroneous personal data concerning him or her. Furthermore, the data subject has the right to request that incomplete personal data be completed, including by means of an additional declaration, taking into account the purposes of such processing.

RIGHT TO RESTRICTION OF PROCESSING
The data subject has the right to obtain from the controller the restriction of processing where one of the following applies:

  1.     the accuracy of the personal data is contested by the data subject, for a period allowing the controller to verify the accuracy of the personal data;
  2.     the processing is unlawful and the data subject objects to the erasure of his or her personal data, demanding instead that their use be restricted;
  3.     the data controller no longer needs the personal data for the purposes of the processing operation, but the data are still required by the data subject for the establishment, exercise or defense of legal claims;
  4.     the data subject has objected to the processing under article 21, paragraph 1, during the verification as to whether the legitimate grounds pursued by the data controller prevail over those of the data subject.

RIGHT TO BE FORGOTTEN
The data subject has the right to obtain from the controller the erasure, as soon as possible, of personal data concerning him or her, and the controller has an obligation to erase such personal data as soon as possible, where one of the following grounds applies:

  1.     the personal data is no longer required for the purposes for which it was collected or otherwise processed;
  2.     the data subject withdraws the consent on which the processing is based, and there is no other legal basis for the processing;
  3.     the data subject objects to the processing by virtue of his or her right to object and there are no compelling legitimate grounds for the processing, or the processing is used for canvassing purposes;
  4.     personal data has been processed unlawfully;
  5.     personal data must be erased in order to comply with a legal obligation laid down by Union law or by the law of the Member State to which the controller is subject;
  6.     the personal data concern children in the context of a service offer.

RIGHT TO DATA PORTABILITY
Data subjects have the right to receive the personal data concerning them that they have provided to a data controller, in a structured, commonly used and machine-readable format, and have the right to transmit this data to another data controller without the data controller to whom the personal data has been communicated having any objection, where:

  1.     processing is based on consent or on a contract, and
  2.     processing is carried out using automated procedures.

RIGHT TO OBJECT
The data subject has the right to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her if the processing is necessary for the performance of a task carried out in the public interest, or if the processing is necessary for the purposes of the legitimate interests pursued by the controller This also applies to profiling based on these provisions. The controller shall no longer process personal data, unless it can demonstrate compelling legitimate grounds for the processing which override the interests and rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims. Where personal data is processed for canvassing purposes, the data subject has the right to object at any time to the processing of personal data concerning him or her for such canvassing purposes, including profiling insofar as it is linked to such canvassing. Right to revoke the declaration of consent in relation to data protection. Any person affected by the processing of personal data has the right to revoke his or her consent to the processing of personal data at any time. You have the right to revoke any declaration of consent given in relation to data protection at any time. Revocation of consent does not affect the lawfulness of processing based on consent prior to revocation.
